The Collapse of the 28-Clause Peace Proposal for Ukraine: How Diplomatic Efforts Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency caused by the announcement of a new 28-article proposal for ending the war appeared – momentarily – to have been contained. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its response: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of opposing developments captured the harsh reality of the outgoing year. By day, negotiation efforts are fought: positive announcements are issued from multiple capitals. Considerable effort is allocated on restraining particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the primary tool for achieving "resolution".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was laid bare. Ukraine is able to track projectile deployments from Russian territory, a ability afforded by up-to-date information. From vantage locations, defense planes that had been scrambled to intercept incoming cruise missiles roared overhead – advanced fighter aircraft delivered to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons thundered: defensive missiles fired to intercept a incoming threat. This was a modern interception technology at work, probably provided by partner states. Every deployment shakes the surroundings, causing tremors. The brief panic quickly gives way to grim resignation: maybe the incoming missile won't hit its mark this time, sparing the city from ruin and additional electricity failures.

Persistent Threats

Following this, a heavy machine gun opened up on a drone close by, part of a defensive team – probably imported technology. Regrettably, the bullets missed the opposing UAV – it pressed on overhead toward its destination.

Periodically, this carried on until dawn. Kyiv awoke to the early updates: several casualties, damage and heating outages in numerous residences as a result of the nocturnal offensive. As typically, everyone still maintained normal activities – experiencing conflict. But those entire period illustrated Ukraine's critical military reliance on Western support – a reliance that regional partners are clearly incapable to substitute in the immediate future.

Unsuccessful Negotiations

The comprehensive proposal from American leadership sparked intense emotion, discussion and serious worry – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after prior negotiation attempts and international summits.

Every new proposal from American administration follows the same pattern: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually win the battle. This cycle will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse specific actors of consistently pushing Russian terms. But that does not seem to be the whole story. US administration operates on a premise familiar among seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The American government assumes that it is impossible to compel Moscow to relinquish the territory that it presently holds in Ukraine's south or east.

The issue is that while accepting these circumstances, Washington does little to deter Moscow, through diplomacy or military means, from assuming that the current condition will not shift further in its benefit in the coming year.

Conflicting Perspectives

Therefore, Russian leadership is certain that the clock favors them – that Ukraine and its partners are nearing depletion. Their incentive to sign a deal that does not give them the maximum possible gain is virtually nonexistent. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's government remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, slowly losing civilians and areas but preventing a complete military breakdown until circumstances change in its benefit.

Existing Situation

Factually, there are no actual prerequisites for a truce. Now, personal considerations are coming into play: political desires to negotiate peace and achieve global acclaim, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the flag against any proposal Kyiv finds unworkable, so that their priority does not shift toward homefront challenges. And although their mission will now be significantly challenging after latest incidents, it remains highly unlikely that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a only one week to kill the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, latest revelations, all did their job.

While new proposals based on previous concepts are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and reflect specific hesitation to modify developments, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the coming months, primarily depend on sustained allied backing.
